§ 1 General - Scope of Application
By placing the order, the customer ("Orderer") acknowledges the following General Terms and Conditions of Luisella ("luis ella") for the use of the luis ella Online Shop.
§ 2 Conclusion of Contract
(1) luis ella is free to refuse orders placed through the luis ella Online Shop. Whether an order is accepted is at the sole discretion of luis ella. If an online order is not fulfilled by luis ella, the luis ella Online Shop will inform the customer immediately.
(2) The order of the customer via the website www.luis-ella.com constitutes merely an offer to conclude a purchase contract. A purchase contract is only concluded with the dispatch of the ordered product and the corresponding shipping confirmation by email.
(3) Unless expressly stated otherwise in the item description, all items are delivered without the depicted decoration.
(4) By clicking the "Buy" button, the customer submits a binding contractual offer to purchase the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after the order is submitted and does not yet constitute acceptance of the contract. The provider can accept the contractual offer by sending a shipping confirmation via email or by delivering the goods within fourteen days.
§ 3 Content of the contract
The contract text is not saved by luis ella and cannot be retrieved after the completion of the ordering process.
§ 4 Delivery
(1) Unless otherwise agreed, delivery shall be made ex works to the delivery address specified by the buyer.
(2) All information regarding the availability, shipping, and delivery of a product is merely indicative and approximate. They do not represent binding or guaranteed shipping or delivery dates. If luis ella determines during the processing of your order that the products you ordered are not available, you will be informed separately via email.
A contract for the unavailable goods does not come into effect.
§ 5 Prices - Payment Terms
(1) All prices listed in the luis ella Online Shop include the statutory value-added tax.
(2) luis ella accepts the displayed payment methods during the ordering process, such as payment via Paypal or payment on invoice. If the customer pays by invoice, the invoice amount is due immediately as advance payment.
(3) The deduction of a discount requires a special written agreement.
(4) If the customer falls behind with the payment, luis ella is entitled to charge reminder fees of €5.00 flat rate. Furthermore, in the event of payment default, the customer agrees to reimburse all costs incurred by appropriate measures for the collection of outstanding claims, including but not limited to legal costs, default interest at the legally permissible rate, expenses, costs of debt collection (including costs of a licensed collection agency and an appointed lawyer) and processing costs.
§ 6 Delivery - Shipping Costs
(1) Standard shipping: The luis ella online shop delivers within Europe free of charge.
(2) Express shipping: Express shipping is only available within Germany for a flat shipping fee of €12.50.
(3) The delivery period is extended in the event of measures taken in the context of labor disputes, particularly strikes and lockouts, as well as in the event of unforeseen obstacles that are beyond the control of luis ella, such as operational disruptions, delays in the delivery of essential materials, provided that such obstacles demonstrably have a significant impact on the delivery of the goods. This also applies if the circumstances occur with subcontractors. The delivery period is extended in accordance with the duration of such measures and obstacles. The aforementioned circumstances are not attributable to luis ella even if they arise during an already existing delay. luis ella will inform the customer of the start and end of such obstacles as soon as possible.
§ 7 Exchange and Return Policy
All goods purchased in the luis ella Online Shop can be returned by the customer within 14 days without giving any reasons as an insured package to the following address:

The returned goods must be in a condition that corresponds to normal use for the purpose of inspecting the goods - as would be customary in a retail store - and must be provided with the original label. In the event of deterioration of the goods due to further use, luis ella reserves the right to demand compensation for the loss in value.
§ 8 Transfer of Risk - Transport Damage
(1) If goods are delivered with obvious damage to the packaging or the contents, the buyer must immediately report this to the relevant delivery person without prejudice to their warranty rights and refuse acceptance, as well as promptly contact the luis ella Online Shop via email mail@luis-ella.com, by phone +49 (0) 163 4522260, or in any other way (post), so that luis ella can assert any rights against the sender.
(2) The risk passes to the purchaser upon acceptance of the delivery item.
§ 9 Retention of Title
The goods remain the property of luis ella until full payment is made.
§ 10 Disclaimer of Liability for External Links
"As far as links to websites of other providers are available, luis ella has no influence on their content."
Therefore, luis ella assumes no responsibility or liability for these contents. The respective provider or operator of the pages is always responsible for the contents of these pages.
